CG&P secured an early dismissal of a complaint alleging employment discrimination and defamation against a New York City attorney. The plaintiff alleged that CG&P’s client conducted a bias workplace investigation and drafted a defamatory investigation report concerning plaintiff’s assertions of religious discrimination, which purportedly caused or contributed to plaintiff’s termination over a year later. The complaint alleged claims including defamation, tortious interference with business relations, intentional infliction of emotional distress, and aiding and abetting employment discrimination. CG&P was able to secure a dismissal by establishing that plaintiff’s intentional tort claims were based solely upon conclusory allegations, that the termination was not the result of any conduct on the part of CG&P’s client, and that certain of the intentional tort claims were time barred.
