For the third time in as many weeks, CG&P has obtained the dismissal of an action against an attorney. In a decision issued late last week, CG&P’s pre-answer motion to dismiss fraud and breach of fiduciary duty claims against a trusts & estates attorney was granted by Nassau County Judge Jack Libert. Earlier in the week, the firm obtained summary judgment in a legal malpractice action against an attorney who allegedly failed to commence a personal injury and wrongful death action on behalf of the plaintiff, and three weeks earlier, the firm secured a pre-answer dismissal of a malpractice action against a Manhattan matrimonial attorney.
