CG&P Obtains Dismissal of Complaint against Air Medical Transportation Provider

In this action for medical malpractice and wrongful death, CG&P’s client, an air medical transportation provider, was called to provide emergency medical assistance to the plaintiff, after he was found unconscious in a backyard pool. It was alleged that the air medical transportation provider was negligent in failing to timely respond and failing to provide proper medical assistance. On CG&P’s motion for summary judgment, the Court dismissed all of plaintiff’s claims against the air medical transportation provider. The Court found that CG&P successfully demonstrated - through the expert affirmation of a critical care specialist - that the air medical transportation provider responded appropriately and provided appropriate emergency medical assistance to the plaintiff. The Court also agreed with CG&P’s argument that the alleged negligence of CG&P’s client did not cause the plaintiff’s death. The case was handled by CG&P Partner Michele R.
