The plaintiff’s complaint against a physical therapist in a nursing home was dismissed on CG&P’s motion for summary judgment. The plaintiff decedent, who was a resident of a nursing home, suffered a fracture to his left hip as a result of a fall that occurred during a physical therapy session. The plaintiff decedent underwent open reduction surgery with internal fixation. It was alleged that the plaintiff decedent’s fracture and surgery caused or contributed to his death. CG&P successfully demonstrated that the physical therapist was entitled to summary judgment because there was no evidence of negligence on her part. The case was handled by CG&P Partner Michele R.
