CG&P has secured the dismissal of a medical malpractice and wrongful death action. The plaintiff, age 42, died of an acute aortic dissection. The plaintiff’s estate sued for damages alleging that the nurse practitioner failed to diagnose an aortic dissection; and that the failure to diagnose deprived the plaintiff of a chance for a cure. The Court found that the plaintiff’s expert affidavit was conclusory and speculative and was insufficient to refute the showing made by the nurse practitioner on issues of compliance with standard of care and proximate causation.
